Booking Terms and Conditions.

Please read carefully in full before making payment and booking.

‘’We" and “Us” refers to Kendall Nichole Frey and Stephanie Berk. ‘You’ and ’Guest’ refers to the client that made the booking.



Terms of agreement
(a) By booking and attending ‘Sensual Initiation Retreat’, you are agreeing to comply with and be bound by the following terms and conditions.

(b) The term ‘us’ or ‘we’ refers to Kendall Nichole and Stephanie Berk. The term ‘you’ or 'I' or ‘Guest’ refers to the client that is making the booking to attend the retreat. The terms 'retreat' or 'program' or ‘offering’ refers to all aspects of the services on offer, to include, but not be limited to, the classes, accommodation and activities.



Booking procedure
(a) Upon making a booking with us for the Sensual Initiation Retreat, each person attending accepts the terms of these booking conditions.

(b) Your place is secured and reserved for the Sensual Initiation Retreat by paying a non refundable deposit of $555 USD. This deposit is non-transferable. An invoice for the remaining balance will be issued after the deposit is made and will need to be paid in full no later than 2 weeks prior to the retreat start date. (by May 28th, 2022).
50% of the balance will need to be paid by May 1st 2022 to ensure you are on track to pay in full.

You are more than welcome to pay in full now, and if you plan to pay closer to the retreat date, please be in communication with us about your plan.

If the balance price of your retreat is not paid on time, we reserve the right to cancel your retreat and retain your deposit plus any additional amounts paid per cancellation policy below.

(c) Last minute bookings made 3 weeks or less from the retreat start date, (this applies to all bookings made on or after May 21st, 2022) must be paid “in full” at time of booking.

(d) Additional excursions and/or treatments and/or activities booked locally are your own responsibility and are done so at your own risk and cost.

(e) You are responsible for booking your own airfare. It is not included in the cost of the retreat and is solely the guest’s responsibility to book and inform us of accurate arrival and departure time. Please send us your flight information no later than June 1st 2021.

f. A group shuttle is available to the retreat center from the airport, included in your retreat investment, and there is also one available the morning that the retreat ends (only on that morning). If you would like to do that, please let us know by May 21st. Pick up time is Saturday June 11th at 10 AM. If you are unable to make it to the shuttle at that time, you will need to find another way to the retreat center. Please arrive by 3 PM.

(g) If you would like to be placed with a specific roommate(s), you must notify us as soon as possible with the name of the person(s) you would like to room with. If they are not paid in full 2 weeks prior to start of the retreat or cancel for any reason, you will be placed with another roommate of our choosing. Final room assignments will be given upon arrival.



Payments
Once your $555 deposit is made, you may make subsequent payments towards your retreat balance in any increments (minimum $150 at a time unless final balance due to be paid in full is less than $150).

Retreat MUST BE paid in full by May 28th, 2022. We accept payments by Venmo or PayPal. When using PayPal you MUST SELECT FRIENDS & FAMILY so that total due is received by Us. If Friends and Family is not selected and we incur fees, the fees will be added to your final balance to ensure that we receive the full amount for your retreat. When making payments, please indicate in the note section, the name you are registered under and specify that it is a payment toward your retreat.

Cancellation policy
(a) 8 weeks or more before the start of the retreat: 100% refund, minus the non refundable deposit.

4 to 8 weeks before the start of the retreat: 50% refund, minus the non refundable deposit.

Less than 4 weeks before the start of the retreat: 0% refund will be given.

(b) You may cancel your retreat at any time provided that the cancellation is made by the person who submitted the booking and is communicated to us in writing via email.

Cancellation will take effect from the day that the written request is received by us. Once your retreat has commenced, no refund or partial refund or unused portion of your retreat will be repaid in the event of cancellation by you.

(c) If Covid-19 restrictions prevent travel into Costa Rica, the retreat will be rescheduled. In that case, you may either transfer your payments in full for the new date/location proposed or receive a 100% FULL refund including “ALL” deposits. Clause 3(d) still applies in this instance where there will not be any compensation by us for flight costs, transfers or any other associated costs.

(d) In the very unlikely event that the retreat is cancelled by either party, there will be no refund or compensation available from us for your flight costs, transfers and other associated costs.

(e) We reserve the right in any circumstances to cancel the retreat, in which case we will offer a full refund of all monies paid or you may choose to transfer your funds to a future date.

(f) Compensation for losses including flight costs, transfers and other associated costs will not be paid if we are forced to cancel or in any way change your retreat due to war, threat of war, invasion, riot, civil war, strike, rebellion, revolution, industrial dispute, terrorist activity, infectious disease/epidemic, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force majeure. We will however offer the same options as in clause 4(c) in case of Covid 19 travel restriction which is the option to transfer your full payments to a rescheduled date/location or the option of a FULL REFUND.

(g) It is not possible at any stage to transfer your booking to another retreat or service unless previously specified such as Covid-19 preventing travel or force majeure. See clauses 4(c) and 4(f)



Changes to retreat
(a) It is highly unlikely that we will have to make any changes to your retreat, but arrangements are made many months in advance and it is always possible that unforeseen changes may have to be made. We are exempt from fulfilling our contractual obligations for causes that could not be anticipated and/or are beyond our control, including an act of God, act of man, act of government, and other impersonal events or occurrences. That being said, we operate in the highest integrity and will endeavor to provide you with all of the services mentioned. Whilst all reasonable efforts will be taken to ensure this, it may be necessary in some circumstances, eg extreme weather or environmental conditions outside our control, to change excursion or other offerings or relocate guests to another resort or venue of similar standard in the locality. In such cases a supplement may apply.

(b) We reserve the right to, within reason, change any information advertised at any time, to include, but not be limited to, dates, times, timetable and location of specific retreat activities. In this unlikely instance, we will advise you of any changes at the earliest possible date as it is our goal to always operate in the highest integrity and to keep any unforeseen disruption to a minimum.



Transportation and Surcharges
Unless stated otherwise, transportation costs including, but not limited to, flights, transfers and taxis to and from your home to your local airport, and to and from the airport in Costa Rica are not included in the price of the retreat.

Insurance and health
(a) It is the guest's responsibility to inform the facilitators of any injury/medical conditions when booking and before the start of every session. It is advisable that you consult a doctor or physician before attending the retreat to ensure you are sufficiently fit and healthy to participate in yoga and dance classes and any other activity that has been arranged.

(b) If you experience any injury or discomfort during any activity organized for you, you must stop immediately and advise the teacher(s) accordingly.

(c) Should you be pregnant or are planning to be pregnant at the time of the retreat, please contact us to discuss before booking.

(d) Per Costa Rica's requirements during COVID, you will need your own travel insurance. We will send more information about this. We hold no responsibility for illness, injury, death or loss or damage to personal belongings at any time (as per the liability waiver in section 7), nor will any compensation be issued in such case.

(e) We reserve the right to stop your participation in any activity, at any time, if we conclude that you are physically, mentally or emotionally unable to do so.

(f) If you have symptoms of Covid-19 please consult your doctor to make sure you are in a fit state to join us for the retreat.



Liability waiver
(a) It is a requirement of anyone attending Sensual Initiation Retreat to accept and abide by the following release of liability:

'I understand that, while the utmost care is taken, neither the individual teachers or the venue will be liable for any damage or injury resulting from my practice or use of the retreat centre, nor any loss or damage to personal belongings. I understand that classes may at times be physically strenuous and I voluntarily participate in them with the knowledge that there is risk of personal injury, property loss or death. I recognize that it is my responsibility to notify the teacher of any illness or injury before the start of every yoga or dance session and I will not perform any posture to the extent of strain or pain. I will notify the teacher before every class should I not want to be physically adjusted. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Kendall Nichole Frey or Stephanie Berk or members for any injury, property loss, or wrongful death, whether caused by negligence or otherwise.

(b) The release of liability statement applies to the duration of the retreat and every session or activity you participate in, whether in a group or private setting. If this statement is not accepted, your booking will be terminated and any monies paid in advance will not be refunded.



Alcohol / Drugs / General Behavior Policy
Guests should not practice any of the ceremonies and rituals we will be participating in under the influence of alcohol, drugs, or both, and doing so will result in immediate dismissal from the session, retreat, or both, with no refund being issued.
All guests must be respectful and must not engage in offensive, illegal or immoral acts. Should this be a situation or should a guest become a nuisance to staff at Finca Mia Retreat Center, Kendall Frey, or Stephanie Berk, then we reserve the right to ask a guest to leave the premises or suspend their activities if it is appropriate to do so, without any compensation.




Right to refuse
(a) We reserve the right to dismiss or refuse entry to any session or the retreat at any time at the teacher's discretion with no refund being issued, in the event of breach of any of these terms and conditions, or disruptive behavior.



Privacy policy
(a) We will not pass on your information to any third party or organization without your permission. We deeply respect your privacy.

(b) We will use your details to inform you of updates about the retreat, and any future events. You can unsubscribe at any time by selecting the unsubscribe button at the bottom of the email.



Passport and visa requirements
(a) You are responsible for ensuring that you have a valid passport with sufficient expiration date remaining and any necessary visas or required inoculations or other health requirements. You must have at least 3 months remaining on your passport in order to enter into Costa Rica.



Complaints
(a) If you have a problem during your retreat, please inform a member of our team immediately, who will immediately endeavor to rectify the situation. If your complaint cannot be resolved locally, you must advise us in writing on your return. Please note that we cannot guarantee nor be responsible for the individual behavior of any group member or other guests on your retreat, though we do not anticipate problems and reserve the right to expel anyone for disruptive behavior



Photographs/Videotapes
We will at times be photographing and/or videotaping portions of the Retreat. Due to the sacredness of our offerings, we take great care to limit the amount of time our professional photographer is in the space as well as what she is photographing. We wish to use such photographs/videos in its advertising, displays, publicity materials, and publications. Participants are deemed to have consented to ‘us’ using such images of ‘you’. However, if you prefer not to appear in ANY of the images/footage, please inform us prior to the commencement of the Retreat so that we may honor your request.



Release/Responsibility

I agree that Kendall Nichole Frey, Stephanie Berk, and their representatives, except for gross negligence or willful misconduct, shall not be held liable for any injury, damage, loss, delay or irregularity that may be occasioned for any reason to me, including, but not limited to any defect in a vehicle, the acts or default of any company or person engaged in conveying a participant, acts of God, terrorism, acts of war, or detention; delays or expenses arising from quarantine, strikes, thefts, pilferage, force majeure, civil disturbances, government restrictions or regulations, accidents by aircraft, boat, bicycle or motor vehicle, or in any restaurant, excursion or accommodation; failure of any means of transportation to arrive or depart as scheduled or changes in transit, or retreat center services; missed airline or other transportation connections; or for additional expenses resulting from changes in exchange rates, tariffs, or itinerary. The participant agrees to assume any risks associated with the Retreat and agrees no liability will be attached to Kendall or Stephanie. By paying the non refundable deposit, the participant release Kendall and Stephanie from any such responsibility or liability. It is therefore suggested participants purchase their own cancellation, property damage (including luggage) and accident, travel insurance.



Acknowledgement & Acceptance

I have read and agree to all of the above Terms and Conditions and understand all of the information provided pertaining to the Retreat. By paying my $555 non refundable deposit and registering for this retreat, I am agreeing to all the terms and conditions listed.
